What can be considered a binding promise in court?

06-Dec-2023 (In Startup Law)
This is just for legal advice. What can be considered a binding promise in terms of court and my company be held liable for? Suppose I tell my client through chats/email in my sales pitch that my company will increase sales of the respective clients, or using my product will do XYZ, although I'll never mention 'promise' or 'gurantee' in my messages or marketing material and I'll never mention it any contract, can client still sue me if the results are not as expected?

Well, despite you do not mention Promise or use word Guarantee in your Sales Pitch via your chats, the mere language which you are using need not signify certainty or promise or guarantee by use of other words like our 'company will do for you', rather than, your company can use words like 'our company may do for you,' if your company does not want to give guarantee.
