Q: PH(OL) Candidature not considered in direct recruitment

I, appeared and qualified written and interview stages of selection process under direct recruitment ESSE 2023 by NESTS (An autonomous organisation under MInistry of Tribal Affairs). But in final merit result declared on June 05, 2024 my candidature is rejected citing reason that my PwBD category is not as per advertisement, however as per Central Govt Rules enshrined in Gazzette notification January 07, 2021 I am eligible for the said post.

Advocate Alankrit Bhatnagar  answered
In this scenario we have to send a detailed representation to the concerned department showcasing the eligibility and will seek decision on the same and if the department doesn’t reply then the appropriate course will be to file a Writ Petition before the appropriate high court

Q: Illegal termination due to BGV verification and report not submitted

I have joined a company 2 months back . last week they told me that my BGV is negative and I have 7 days time to prove positive results . though after repeted mails, msgs and verbal communications company is failed to provide the BGV report and with in 24 hrs removed me from all professional grups and bloced my mail id and ph number . please advice

Advocate Alankrit Bhatnagar  answered
Based on the facts stated, the employer appears to have taken adverse action without providing you a copy of the alleged negative Background Verification (BGV) report or a reasonable opportunity to respond. Preserve all emails, messages, appointment letter, offer letter, salary slips and any communication relating to the BGV issue. Send a written email immediately seeking (i) a copy of the BGV report, (ii) details of the adverse findings, and (iii) clarification regarding your employment status. If the company has terminated your services solely on the basis of an undisclosed BGV report, you may consider issuing a legal notice seeking disclosure of records, reinstatement (where applicable), payment of dues, and compensation for wrongful action, depending upon the terms of your employment contract. The exact remedies will depend on whether you were on probation, the nature of your employment, and the termination clause contained in your appointment letter.

Q: What if husband files section9 in response to lawyer notice for mutual

If I send advocate notice (not from court) to seek mutual divorce and husband files section 9, what steps do u suggest? I m separated since 5 yrs. Unemployed. No case filed, no maintenance provided. Can I file maintenance and argue that husband filed section 9 just bcoz I sent notice but never wanted me back till now? What to do if section 9 filed in response to lawyer notice?

Advocate Alankrit Bhatnagar  answered
You have to decide whether you want to go for mutual divorce or you wish to have a contested divorce. You can certainly file for a maintenance case as well but it totally depends on what you want.Section 9 of husband has no bearing to whatever you wish to do. For section 9 you need to decide whether you want to return back to husband or not.
