Procedure for change of name in flat ownership documents

I am having flat at Pune which is my & my son name. I have to include my son name due to loan. At that time my age was 53 years and bank was not giving loan on single name. I have made all payments from my account and my son has not paid any thing. I want too include my wife name in that deed and take out my son name. My son will sign any legal documents for his mother. How I can do the same?

Greetings. Make Deed of Gift between your son and his mother showing your son is gifting his share of flat to his mother out of natural love and affection (No consideration). Register it. Its has nominal stamp duty. submit the same with society and apply for membership in your wife's name and remove the name of your son form record of society. Other option is to execute Release Deed by your son in favour of his mother but its registration requires payment of stamp duty. thanks.

As per the facts narrated by you, your son is co-owner in the said flat in Pune with you. If you want to take out his name from the said flat, you should get Gift deed executed and registered by your son in your wife's name so that you and your wife will become co-owners. And for the said Gift deed, registration and Stamp duty expenses are nominal.

you have to make correction deed. it should be registered, there might be you have to pay stamp duty because your wife is not in your blood relation. this the law regarding this type of deed. so be clear
