Is there any law to protect tenants from harassing neighbours

I have given my flat on rent to a group of working professional boys ..however, some apartment owners always have concerns and want me to give flat to family only. Our apartment society has not been formed or registered . Society is managed by some group of owners and every time they come up with their set of rules who are staying in the apartment. These owners frequently call me to trouble and say they will lodge a police complain of any matter even for no issues they create some and try to harass .. I need assistance on 2 points 1) If I have an official rental agreement, police verification done for tenants is there anything else I need to do safeguard from such neighbors harassing by blackmailing that they will go to police 2) I am not sure if there is any rule from Maharashtra government, not to allow visitors of the opposite gender in the flat during normal day time. What shall I do?

Hello ,

If the society/Apartment is not formed yet and you are the owner of the flat you have full legal right to let the said flat on registered Leave and license basis and as you have also done police verification there is no hassle at all.
make sure the tenants does not create nuisance which create disturbance to neighbors.

As per my knowledge there is no such law passed by Maharashtra state Govt. but registered society pass bye laws and which passed in society meeting which governs the movement of visitors within society.

Hello,

The Article 14 and Article 15 of the Constitution of India has provided for equality before the law and prohibit discrimination on the grounds of religion, race, sex, place of birth or any of them. Hence, “Every member of the society has the right to give his flat on leave and license basis and the society cannot restrict bachelors or spinsters.

The requirement of obtaining the prior permission from the society to give the flat on leave and license basis, has been removed from the new model bye-laws.

The Members only need to inform the society about the flat being given on rent, by submitting a copy of the duly registered leave and license agreement and a copy of the tenants’ information submitted to the nearest police station.

You report this harassment to police and safeguard yourself. You may call me if you need any assistance.

Answer: You have complied with all the formalities. You can file a formal complaint to the society manager. If things have spiraled out of control then you should be the first one to make a police complaint against the ones harassing your tenants. You can file an NC against them;

Answer: Yes there is no such rule. Do still check the society bye-laws and that such no rule has been clandestinely introduced in the same.
