Company not settling and forcing to rejoin what can be done

13-Jan-2023 (In Labour & Service Law)
I was working in software company and I had resigned from my job on 18th October 2016 .It has been 3 months but still I haven't got my full and final settlement. I tried to contact with Hr and manager as well , each and every time they make excuses and now they stop picking my phone and replying mail as well. They are also forcing me to work there after getting relieved. Is there any law for this situation and how can we take them in legal way.I got proper relieve and left job on date which is provided by them. Please let me know if there is any way to get my dues and service letter as well. Thanks in advance!

You can send them a legal notice to clear your dues at the earliest otherwise the only option left with you is to file a suit for the recovery of your salary along with damages. There must be a employment agreement between you and the company, which will also have to be seen.

Dear Sir,
Quite a few companies indulge in such practices. As of now the best option available to you is not to re-join your last Company and send them a legal notice demanding your dues and for this give them a reasonable time of 2-3 weeks. Thereafter, if the dues are not settled, depending upon the type of Company and your role in it, you can either approach the Civil Court or Labour Court for recovery. However do keep in mind that in our Country it takes quite a bit of time to finish a legal case.
