Company is not giving full and final settlement to the employees

06-Jan-2023 (In Labour & Service Law)

Our company has offices at Gurgaon, Mumbai and Karnal. The company has not paid full and final settlement to the employees who have left the company. Further the company is also not paying full salary to its present employees. The salary of the employees range from Rs. 15000 to Rs. 2,00,00/-. Kindly advise can we all file a case against the company for recovery of our salary jointly or we have to file different cases in labour court or civil court. How we can get the due amount from the employer.

Depending on the post at which you are in the company it will have to be checked whether you fall in the definition of 'labour'. If you do you may already the labor court. Else you will have to file a suit for recovery in the civil court. Ideally each litigant must approach the city separately in this scenario because all employees seem to belong to different categories. You could also approach the High Court for the winding up of the company which may be done jointly.
