Whoever commits an affray, shall be punished with imprisonment of either description for a term which may extend to one month, or with fine which may extend to one hundred rupees, or with both.

If the summons has been duly served upon the witness and yet the witness fails to appear in court, the Court can issue a warrant for the arrest of the witness. The witness could be taken into custody and remain in custody until the day of the trial.
If a witness fails to appear in court due to a valid reason, such as illness or unavoidable circumstances, the court may consider the reason for the absence and take appropriate action accordingly. The witness or the party who summoned the witness may apply to the court for an adjournment of the hearing, providing evidence of the valid reason for the absence. If the court is satisfied with the explanation, it may grant an adjournment and fix a new date for the hearing.
However, if the court finds that the reason given for the absence is not valid or sufficient, it may proceed by issuing a warrant for the witness's arrest or forfeiting the recognizance, depending on the circumstances of the case.
