dear client as per your query I can only suggest that if both the parties have signed the MOU it's a matter and understanding between the parties it's not a legal document for future paid consultations please contact us with your relevant documents.

Dear Queriest if it is taken in writing in a Mou then it can be used as a legal safeguard so that they cannot claim anything. in case the other party tries to take advantage of the same, for more information about the same kindly call me.

yes it has got the evidentiary value. you can use it later or at anytime when the case comes up that dowry niether taken nor demanded.... although it cannot stop anyone from filing dowry case but it can definitely be used as having evidentiary value.

Hi, As per the information You have shared, a signed MOU can only be used as an evidence in case a case is filed by the party. But it cannot debbared anyone to file a case. You can have benefit from that Signed Mou

Sir To understand this, a detailed judgement of the Hon'ble High Court of Delhi had been passed titled Rajat Gupta v. Rupali Gupta. Merely by signing an MOU doesn't bar the party to file litigations against the other party unless that a decree was passed by the concerned court regarding that MOU. To understand this better, you may consult me.

No. In case any dispute arises in future, the MOU may only be one of the safeguards but it will not debar the complainant to file a case. The complainant is free to file a case under relevant laws. The object of MOU shall be well drafted and it must be acted upon immediately or as detailed thereon specifically.

A MOU is merely a statement of understanding between two or more parties which when made has no enforceability in the eyes of law as such an agreement has no intention to create a legal bond between such persons. As a result of which, if in case there is a breach of such MOU there is no relief. provided there is a specific clause inserted with that regard.

Dear Client According to Indian law, a Memorandum of Understanding is not a legally binding agreement in a court of law, but to make it enforceable in a court of law, an agreement must consist of the elements of Section 10 of Indian Contract Act, 1872. Please feel free to reach out to discuss further. Will be able to advise you further post perusal of your documents. Regards.

This will give strength to opposite party but if the MOU is signed under any pressure, threat, coercion, undue influence, mis-representation or
fraud then that MOU is not valid ! All the best n b in touch

Well this is called pre- nuptial agreement , which is generally not valid in India per-se. but still we can use the agreement to prove and corroborate in the court that no dowry was either demanded or taken. Thanks. Advocate Naveen Arya
