LEGAL status of a child born abroad to Indian parents but his borth is not registered with the Consulate General of India within a period of one year? Whether he is Indian National?

You have to register the birth of your child at the Indian consulate. You have to do it within one year from the birth of the child, as after that time you will need a special permission to register it.

You - as parents - are expected to also provide an undertaking in writing that your child does not hold any other citizensip. So your child will not be able to hold two citizenships - one of USA and one of India.

You do not need NRI status for your child if you are moving to India in the long run. However if you are considering keeping the US passport for your child, then you may consider Overseas Citizenship of India (OCI) status. Being an OCI provides you with many rights of Indian citizens, however you cannot:
- vote in Indian elections
- hold administrative, political, constitutional and governmental posts
- acquire agricultural and plantation properties in India (but can inherit them)
