Regarding filing divorce and alimony and maintenance from my husband

22-Jul-2023 (In Divorce Law)
I have been married for six months now. My in-laws have been coercing me to work as they are in a lot of debt which they failed to mention prior marriage. Also, my parents gave dowry at the time of marriage. On what grounds can I file a divorce? Also, am I elligible for the alimony as my family spent quite a lot on the marriage and I am not the only child. I belong to a sikh family.

You can file a case of domestic violence against your in laws for their acts and deeds. You can also seek monthly maintenance from your husband since you are non working. some pressure would be exerted on them by litigation. Then their is an opportunity of mediation wherefrom things may turn better and better sense may prevail. take your chance. take my services. Thanks and Regards

Yes you can seek divorce however as per law divorce is granted only after expiry of one year but there are exceptions to that as well. You are also entitled for alimony and you right for alimony won’t be affected on the grounds that your family spent huge amount in your marriage.

Knowing the bit of the case as per your mentioning, it can be inculcated that you have been subjected to dowry harassment and mental torture. The best fits your case is to first file a complaint in CAW cell and then to proceed for divorce on the ground of harassment. For any further legal assistance please feel free to contact Thanks

Good-evening ma'am, would be happy to assist you with your query, Generally a divorce cannot be filed before a year has been passed from the date of the marriage, however you may file for an annulment of the marriage which has the same effect as of a divorce.
