how to stop 125crpc interim maintenance in first hearing

When is the right time to submit the 125crpc reply and income affidavit on the first day of hearing or later or shall I wait till the wife submit the new income affidavit ?. If I ask the court for 1 month time to submit my reply and income affidavit in this scenario will court assign interim maintenance? If I request judge to send case into mediation but my wife do not want to send into mediation can judge still send case into mediation ? If the case goes into Mediation do i still need to pay interim maintenance ? can I show audio recoding proof to judge in first hearing in which my wife threatened to kill me and family members to stop the interim maintenance ? or can i show MLC records to judge in first hearing to show wife cruelty to stop the interim maintenance ? what is best way to stop interim maintenance if wife is working ?

Hello, Greetings, We have perused your query and would advise you that the interim maintenance would be decided once the pleadings are completed from both the sides. On the first day of hearing your lawyer will submit the vakaltanama and can seek time for filing a detailed written statement. You can move an application for referring the matter to mediation also if you are willing for some settlement.

It is best to file a reply to the said application for interim maintenance citing the reasons and grounds why interim maintenance should not be provided. If you want you can wait for her to submit the abovementioned affidavits.
