Hello,nI am an NRI living abroad and my wife is staying in India. She had filed FALSE 498a against me and my parents at Dhanbad, Jharkhand in the month of November 2022.Police sent 41 notice to my native place in Bihar.I sent request application through registered post to grant me some time to visit India.After that we didn't hear anything from police or court but yesterday my lawyer found out that NBW has been issued against me on 12th April 2023..Please advise what should I do
As you stated in your query that one criminal case under section 498A FILED by your wife against your family where NBW warrant has been issued against your, under this situation we suggest you to immediate stay the warrant and file petition before Jharkhand High Court otherwise court will issue Section 82 of Cr.P.C and you have to surrender before court. feel free then call for more information.
