12-Mar-2023 (In Divorce Law)
My husband has sought divorce on basis of many false allegations - cruelty. Except a few things that I had confessed to earlier and always accepted, he was forcing me for mutual divorce without exchanging the belongings. I was ready to sign because I also want to divorce him because in fact his family has been cruel to me. I told him that you get the mutual draft made I will read it and then sign it because we both should get what is rightfully ours. Yesterday I received a notice from family court stating all false allegations and the hearing date is 23rd. Kindly guide me.

When facing false allegations by a husband in a divorce case, it's essential to take the following steps to defend yourself and prove your innocence in court:
  1. Gather Evidence: Collect all relevant evidence that can refute the false allegations. This may include text messages, emails, call records, or witnesses who can testify on your behalf.
  2. Consult with an Attorney: Seek legal counsel from an experienced family lawyer who specializes in divorce cases. They can provide guidance on the legal actions to take.
  3. File a Counter-Affidavit: In response to the false allegations made by your husband in the divorce petition, you should file a counter-affidavit providing your side of the story and presenting the evidence you've gathered.
  4. Attend Court Proceedings: Attend all court hearings and proceedings to present your case effectively. Your lawyer will represent you in court and present the evidence.
  5. Seek Mediation: Explore the option of mediation to resolve the disputes amicably. It can be a quicker and less adversarial way to settle issues.
  6. Legal Action Against False Allegations: If your husband's false allegations are severe and malicious, you can consider taking legal action against him for making false statements.
  7. 498A and Dowry Cases: If your husband has filed a false 498A or dowry harassment case, it's crucial to provide evidence of your innocence. Consult with your lawyer on how to build a strong defense.
  8. 125 CrPC Judgement: If maintenance (under Section 125 of the CrPC) is an issue, present your case with supporting evidence to prove your financial situation and need.
  9. Expert Testimony: If necessary, consult experts or professionals who can provide expert testimony to support your case.
  10. Stay Calm and Respectful: Maintain composure and respect during legal proceedings. Avoid confrontations or aggressive behavior.
Remember that each case is unique, and the strategies to defend against false allegations may vary based on the specifics of your situation. Consulting with a qualified family lawyer is crucial to navigate the legal process effectively.
