Dismissal Of Dv Charges Due To Vague Charges And Child Custody

I wanted to submit an application as the charges under Dv are vague, unsubstantiated and not specific. Please contact if you have earlier submitted such applications.

You can either submit a counter written statement in the Application u/s 12 dv act or if the complaint in DV act is really vague and unsubstantiated you can submit a discharge application and if still relief is not given we can always move forward with quashing of the case

You can challenge the maintainability of the DV petition on the ground that the entire case is set up on distorted and vague facts. The court can decide the maintainability of the case before getting on the merits of the case. For further assistance feel free to contact Thanks

Hi. Yes i have dealt with such cases. You can even approach the HC for quashing the dv petition and can also file revision against the cognizance order. The remedy will depend on the details mentioned in the dv petition. Please reach out for discussion

yes you may file that application. it is called a written statement, you may file it within the stipulated period ie., 30 days or on the next date of hearing. you may also file additional documents with evidentiary value.

yes you can file an application with such a charge is not attracted to the same court . if this court is not considered the application , you can file appeal for partucular charge. the process is very simple
