Q: Case of Cheque Bounce under 138 of the N. I. Act

Hello,A case has been filed on me by a bank for nonpayment of their loan. I was a very old customer of the bank and paid my EMIs on regular basis for many years even during pandemic. However after 2021 my situation changed as wasn't having any job for 2-3 years and therefore couldn't pay the balance EMI of personal loan. You need to collect details of your all emi payment done by you, appear before the court on a fixed date , prepare your defence. if amount is very less than prefer to settlement, the process is very simple to defend the case ,you need not work.
