24-Apr-2024 (In Divorce Law)
Need advise on procedure, how long it takes to separate mutually. Any legal rights applicable to me for mental cruelty? Can I still live with them until legally divorced???
mutual divorce is a legal procedure where both partners agree to end their marriage and settle all issues such as child custody, property division, and alimony.
When people in a marriage of at least a year decide that they cannot stay together for any reason, they have the right to file for divorce on mutual consent.

As per the new Supreme Court provisions through mutual you can be separated within 3 months.
Contested divorce and mutual are entirely different.
If you want any rights or privileges with regards to various issues you can go for a memorandum of understanding along with mutual.
The terms should be agreed for both of you.
