Dear ma'am, there are options for you here in India to seek divorce, e.g., you may either get that U.K. decree executed here in India or you may file for a mutual divorce in India afresh. If your husband is not willing to give you a mutual divorce, you may file a contested divorce on various grounds, which you may discuss with me in detail. Regards!

Divorce should be on grounds recognised by Indian Law, meaning only on the grounds under which the divorce can be pronounced in India the Divorce Decree is valid. No Fault Divorce is not a ground recognized in Indian Law, thus a divorce decree on this ground which is not recognized would be invalid in India. You need to apply for a mutual consent divorce in India.

When it comes to mutual consent or consensual divorce order, the verdict conceded by a Foreign Court is viewed as a lawful, valid and official decree in the Indian Courts by the virtue of Section 13 & Section 14 of the Indian Civil Procedure Code, in which Section 13 lists the conditions when a judgment given by foreign court shall not be viewed as legitimate in India and Section 14 clearly states that when the Indian Courts would deem the Foreign judgment to be the final one.

Does your marriage happen in India or UK ? If your divorce will be granted by a court of competent jurisdiction in UK , it would be duly recognised as valid provided it is a certified copy of that judgement duly attested by UK court & Indian embassy
