Questions Answered by Advocate Baddam Aravind Reddy
Q: Breach of agreement or cheating ?
Twenty-five years ago, my father sold 3 guntas of agricultural land on a white paper(not stamp) without including the survey number of the land. The agreement clearly stated that we should register the property when required. The buyer has been in possession of the land for the past 25 years and is now insisting that we register the property. He has also complained to police, who are threatening to file a cheating case if we don't register it. is this a civil case or criminal ?
Advocate Baddam Aravind Reddy answered
hi first need to see whether any complaint had been registered against your father and if yes then you could file quash petition as it is a criminal case and you could defend it on the ground that it is not binding as it is not registered
Q: Faulty Product and No Customer Service
Hi, I have a small store in US to promote Indian Handicrafts. As a part of that, I tried to buy some return gifts from Hyderabad with a retailer called Ashtok. What they sent me are 75-80% damaged products which I couldn't sell. I have been talking to them for last 4 months, where I have messages of their acknowledging the mistake. Now when the time has come to replace, they are asking me to send the damaged products at my cost. I didn't claim the shipping I paid for this product (10k rupees).
Advocate Baddam Aravind Reddy answered
hi if the products or goods which you had ordered from the website are damaged or broken and if they are asking to pay for the shipping charges then you could send legal notice and if they are not replying then you could file consumer complajnt
