498A and others; first date where Magistrate said no cognizance taken

23-Feb-2023 (In Divorce Law)
What if in the first date of 498A, the Magistrate said that no cognizance is taken and give another date after five months ? what should we take out of this by not taking cognizance in first date ?

The word cognizance indicates the point when the Magistrate first takes judicial notice of an offence. In your case it normally means that till now the magistrate has not taken any action. On the next date of hearing that is after 5 months he/she will the cognizance.

No cognizance taken by the Magistrate means that your case not been taken view upon by the judge. On the next date the magistrate after perusing the status of your case can take cognizance on your case. However better advice can be given after knowing the charges involved in your matter. Please feel free to contact

Thanks
