Writ petition with false accusitions

17-Jul-2023 (In Criminal Law)
I was in a gay relationship and the guy used to pay me for my expenses voluntarily. He trapped me and forced me to take money from him so that I could stay with him and do as he says. But I broke up and now he put false accusations on me and my family. He filed a writ petition with many serious accusations like an attempt to murder, restrain, stating that he gave me all the money on relying on my friendship. Many more false things on the writ petition. I do not want to go to court or get involved in this. Do I mandatorily need to reply to this by hiring a lawyer? Or I can assume that high court will dismiss this because mostly everything is a made-up story.

If you don't attend the case and represent yourself before the Court how the Court would know your side of story. The Court would only will be able to his side and it will be deemed that you accept the allegations and the judgment may be passed accordingly against you for which you may have to move in appeal which will be more tedious. Moreover representing yourself before the Court is very simple, all you have to do is put a signature in a vakalatnama and that's it, you won't have visit the Court physically even, your lawyer would represent you and protect your cause. If the allegations are baseless it is likely that the petition may get dismissed even in a single day. Also think that if you are represented in the false case and win over in it, it will give a blow to the other side and he will understand that you can't be moulded by false cases which may stop him in future to lodge any such frivolous case further. Many of my clients got such reliefs accordingly. All the best and regards.

In this issue 1stly Writ Petition is not maintainable in High Court. This facts need to be proved at 1st and for that fact finding courts are Sessions Court where these allegations are needed to be proved. If the Court finds necessity to hear from you then engaging a lawyer to fight back is necessary!
