Q: BLRO not recording name or updating land ownership

After coming to know that our Vastu land was vested. We filed a case on civil Court which later on granted us right to title and restrained the state from disturbing us. Hence we applied to get our names recorded with the BL LRO office. BLRO refused to do it and directed us to ADM LR office and directed to get a verdict from there. ADM LR refused to recognize the Civil Court order wants to give us our own land in 99 years Lease. We do not want our own land on lease that my grandfather bought legally.What can we do next ?

Since you have judgment and decree in your favour you make a detailed petition for correction of record of right to the BL & LRO, a docket no will be provided to you; thereafter nothing as such they will do as per my experience is concerned, then your approach to LRTT Salt Lake against the inaction by BLLRO, then he'll be compelled to act as per LRTT's order and you will get immediate relief. Immediately apply before Hon’ble Supreme Court under Section 25 of the Code of Civil Procedure for transfer of the case from there to your local Jurisdiction. There are plenty of reported cases where the Hon’ble Apex Court has ordered the same. You should immediately do that before attending the said Court at Chandigarh, if your matter is admitted by Hon’ble Supreme Court, stay will be given on the proceedings in Chandigarh and it won't proceed further. Q: Query about FIR .I want to know how police acts after an FIR.

If an FIR is filed against a person for an mild cognizable offense, can police delay the investigation for 5 to 6 years? Do police contact the accused necessarily whose contact, address is known to police ?

Ofcourse police can't delay this much. If it really has delayed these many years, it's evident that it has been showing its lackadaisical attitude in investigation; in that case you should immediately approach High Court against such in action by logic you eill immediately get relief accordingly. In this way many of clients got relief accordingly from our Hon'ble High Court at Calcutta. All the best and regards



Q: Outstation Transfer during pandemic situation.

I am employee of department of post west bengal circle. In recent rotanional transfer order i have been posted 171km from my residence. No option for preference place of posting was considered during transfer order. Though post was vacant during this pandemic situation it was not considered. Prayer for reconsideration was also not granted. I am covid 19 positive patient and recently have to admitted hospital. My 4 yrs old son ,wife and 70 yrs old bedridden mother in my home. How can i get relieved ?

Your transfer seems to be unreasonable; however as you very well know our Courts naturally fo not interfere with transfer orders except in exceptional circumstances and I think you case may be an exception. You can try your luck in our CAT Calcutta Bench before you are provided with release order or join in your transferred post. This way many of my clients got relief accordingly. Q: Illegal grabbing & construction issue...............................

Our ancestral property forcefully demolished & new construction work going on it by outsiders (club ). Property in my grandfather's name. Grandfather was made a will, & after his death the PROBATE was granted from the court. As per will my father & two uncle are joint successor of this property. One of the uncle EXECUTOR of this will & overhears administration of our property. But he didn't taking any action against outsiders. I already complaint to the police (GD) & a complaint letter sent to SDO, DISTRICT MAGISTRATE, POLICE COMMISSIONER also with evidence. Already illegal construction work done 75% on our property. I want to recover our property & demolished illegal construction. What is proper wayout ?

Immediately write to the Municipality/Panchayat concerned for demolition of unauthorized construction (I'm sure the club can't have sanctioned plan since they are not the owners; even if they could gather sanctioned plan that would have been obtained illegally and shall be very well cancelled). After that if the Municipality doesn't take any step, immediately file a writ petition in High Court for demolition of the same, the order for demolition shall be passed and the construction shall be demolished. After that take possession and apply for your own sanction plan and after that raise your construction accordingly, even after that if you are objected by the club you can easily get injunction order from the Civil Court injuncting any third party from restraining you. Many of my clients got immediate reliefs of demolition from our Calcutta High Court in these matters. All the best and regards.
