Want to file a defamation case

Someone I know was arrested wrongly in 2019 for sexual harrasment and other charges. On March 2023, he was acquitted by the court. Now what he can do next ?nHe want to file defamation case and a case against the people who has given false statements in the court. Kindly guide how to proceed.

You can always sue them for defamation under section 499 IPC. For that purpose you need to take out all the certified order sheets for the 2019 case and if you wish you can also serve him/her a legal notice regarding your grievances. If he/she fails to compensate you then go for it. For more legal assistance I am just a call away.

hello client as i can see your issue i your issue yes you can file defamation suit as well as other criminal cases as well . in your matter you aquital is been allready done you have full rights to prosecute tht person as that fellow has falsly implicated in a criminal case. so yes you can and get that person sent to jail

Hello Sir. You may very well file a Civil and Criminal Defamation case in the appropriate Hon’ble Court. Further you may also file a case for Malicious Prosecution also. Apart from other statements m, Whatever statement are there in the court record and are defamatory comes well within the Defamation.

The case you should file is for malicious prosecution along with application under Sec. 340 CrPC for lying on affidavit. For defamation, we have to see what grounds you have. for more information, you may consult me.

There is civil defamation as well as criminal defamation, either of which could be filed or both can also be filed. Provided, there is substantial evidence and proof to corroborate the allegations made or to be made in defamation cases. Consequently, you have the relief as sought in the prayer.
