Dear Client,
Bail is not granted automatically. your advocate needs to apply for the same and court after referring the bail application, FIR and statements will grant the bail.
S. 326 speaks about causing grievous hurt by dangerous weapon. Hence based upon the allegations made on your friend the bail is granted. He can also file bail application before sessions court or High court if magistrate denies bail.
It would be advisable if you can reach out to any of the impaneled advocate of lawrato. while going for the consultation do carry all your supportive documents so that proper and precise advise can be given.

In Non bailable offences it is at the discretion of the honourable court. It means nobody has liberty to decide the day and time for release of the accused person.

In Bailable offences the accused person can pray for bail as a matter of right and he shall be released on bail ASAP.

Dear frind,

Here you have not mentioned that whether your bail is rejected by magistrate court or not...?

If it is then you have to file it in sessions court.

Sencoundly it will hardly take one week to get the bail. It is depend oppone I.O when he is submitted his report
