What to do if builder is not giving flat possession

what to do if builder is not giving flat on time allotted ? and it has been delayed by 4 years? i am Christian and caste st.registration paper process are still going on

Venerated Sir,
As per law you have right to file case before Consumer Court for mental and physical agony and possession. You can also file a criminal case for cheating and breach of trust under Indian Penal Code for possession. Feel free to call and give feedback.

Dear Sir

If the builder is not giving possession of the flat as per the time schedule specified in the sale agreement, you can approach consumer forum under the Consumer Protection Act besides availaing remedy under Real Estate Regulation Act.

Immediately issue a legal notice upon the builder. If still nothing happens, move the consumer commission for direction for registration and necessary formalities. consult a good advocate for the same.

If the builder is not giving the possession of your flat allotted to u and not obeying their own rules regarding the time stipulation of allottment of the flat, then u should ask ur lawyer to send a legal notice to builder for allotting the flat soon otherwise u ll fila a consumer case in the consumer court, giving him 10-15 Days to comply ...and if they not comply within ur given time then file a case against him in the consumer court regarding the act of cheating , breach of contract and unfair trade practices.. You have not disclosed as to whether the flat is complete or construction is in progress however if the flat is complete the ask the builder to give you the possession of the property by registering the same on full and final payment of consideration amount and if he refuses to do so then approach the competent court for redressal of your grievances
