Water leakage from 3rd floor damages in 2nd floor.

THe water is leaking from the three toilets of 3rd floor causing major damage as well as inconvenience and hazard in 2nd floor. THe owner is not repairing the toilets despite repeated requests. He says he has no problem then why he should repair. He wants me (owner of 2nd floor) to get his bathrooms repaired and wants me to incur all the expenditure including new granite flooring etc in the bathrooms.The leakage has already caused severe damage at my floor. He refuges to pay even a single rupee for the repairs and instead ask for compensation for the period of disturbance, if any, during the time of repair. Please let me know if he is legally correct? Why he should not pay for repairs and also for damages caused by leakages from his bathrooms?

Don’t waste time in arguments with the fellow just file-a civil suit in distrust court and he will come around to settle the issue with you then at that movement you deal with him whether he will compensate you or vice versa. He has to repair his toilet or otherwise with the help of other members file suit
