Q: Water leakage from 3rd floor damages in 2nd floor.
THe water is leaking from the three toilets of 3rd floor causing major damage as well as inconvenience and hazard in 2nd floor. THe owner is not repairing the toilets despite repeated requests. He says he has no problem then why he should repair. He wants me (owner of 2nd floor) to get his bathrooms repaired and wants me to incur all the expenditure including new granite flooring etc in the bathrooms. The leakage has already caused severe damage at my floor. He refuges to pay even a single rupee for the repairs and instead ask for compensation for the period of disturbance, if any, during the time of repair. Please let me know if he is legally correct? Why he should not pay for repairs and also for damages caused by leakages from his bathrooms?
Advocate Ayush Saxena answered
Hello, As per the information provided by you, it is clear that the person living on the 3rd floor is being unreasonable in asking whatever he has asked. The important thing is he is completely doing illegal thing by not getting his bathroom repaired.
