leakage/seepage from upper floor

Sir, I reside at second floor of independent four floor with stilt house in delhi. From the past three months, a continuous seepage/leakage is coming from third floor's toilet or kitchen. The owner is not repairing his leakage at floor. I am not demanding compensation of my loss of wall paint, false ceiling etc. and just want to repair it from his side. but he is ignoring as he is a big builder in our area. What type of case can we sue against him in court.
First you should prefer sending a harsh legal notice on the builder and ask him to stop the illegal acts forthwith. If not done under the stipulated time, you can approach the civil court under Injunction remedies. If you want the faster results, it is preferable to approach the High court under writ jurisdiction.
you may issue a legal notice to him seeking rhe relief that you want. if he does not pay heed, you may file a suit seeking direction on him to do repairs as you require. you may also consider filing a consumer complaint seeking the reliefs that you want. approaching the consumer forum would be a time saving remedy.
