Filing declaration suit on gift deed done by grandfather and options.

12-Feb-2023 (In Civil Law)
Hi, I'm hindu. My grandfather(has four son's) has given a portion of land as gift deed to one of his brother's wife in 1975. This gift deed was challenged by my grandfather's elder brother son on our behalf from 1993 to 2001 and it was dismissed by high court. In the meanwhile my grandfather's elder brother's sons(4) and my fathers(4) has done family settlement partition deed among themselves in 1990 and all the 8 brothers have already constructed the houses on their allotted portion of the land. Later his brother's wife who has no son but has 3 daughters and one of his daughter's son has done sale deed on his name in 2010(only on our father's allotted family settlement portion of land only). She has died in 2014 As my father did not construct any house on his allotted family settlement land, it is now vacant land, he his claiming our property. Can I now file declaration suit on my father's allotted property? How many chances are there to reclaim my father's allotted property?
