Civil|Family proprerty disputee |between father and his brother, Karna

12-Mar-2023 (In Civil Law)
There was a property registration between my farther and his brothers in 1980. Then in 2004, they made some amendment to the same and made a new partition for the ancestoral property. During the latest one that was made in 2004. A portion of land (2 acres)that belonged to my father (1980)was not considered. There is no mention of the same in the latest partition deed. However, in 1989, my father had got a agreement among his brothers and their sign , which started that the 2 acres belonged to my father and it does not belong to them. My father has the Copy of registration certificate (CRC) for the same. This property has now been given as a gift deed to my sister. Recently my father's brother has come back on this property saying that they need equal share in that and the same was not mentioned in the 2004 partition deed. Is there any way we can claim this land is ours?

The claim is barred by limitation as such now your fathers brothers cannot claim the property... Once a partition deed is executed it cannot be challenged by the persons signing the agreement.. Do contact me for further queries
