I had filed a complaint of Hooliganism against a criminal minded man. Accused filed false counter.I approached the Senior Officials of Delhi Police due to which the SHO filed a case against the accused u/s 107/150 but he dragged me as well. Earlier he was saying that the accused had filed the bond of peace in TIS Hazari Court. I brought this line to the senior officials. Later on I got intimation about false civil suit. The accused also approached the Court for revision of 107/150 which was dismissed by the court. The accused filed false counter complaints against my brother but the 107/150 and Revision Petition was filed against my name but this accused had filed the false civil suit in my brother's name who has nothing to do in this matter. A WS was filed from my brother's side with an application of 340 cr pc which has been registered in the court: Is their any way by which my brother name is removed from this false civil suit and can he file a defamation case against him

Civil cases are very technical cases and if not drafted carefully, can be dismissed very easily provided you make wise submissions in the court. You will find most of the civil cases gets dismissed very early because of some inherent defects in that. Since you have a tangible ground and a litigation background with plaintiff, you have an edge and can do away with civil case.
