Can we defend our case without a lawyer?

Dear expert lawyers, I am curious to know whether I can fight my case without a lawyer in a civil court matter. If yes, how I can proceed? Thanks

file an application to appear in person. while you may know your case better than any lawyer, a lawyer practising in a particular court knows what is required to be said in a given set of facts. it comes with practise and a person not acquainted with the practise of the court may be caught off-guard, not by the factual aspect of the case, but by the practise aspect of a particular court. moreover the emotional attachment to a case may shadow the clinical approach that may be required in a court. however it is your choice and like already said, you may appear and represent your matter by filing an application in the court for leave to appear in your matter in person.

yes you can get the permission from court about your willingness to fight your own case. generally it is advisable to get engaged a qualified lawyer because civil cases are too tricky. and the trial procedure through civil procedure code is not so easy. but even you want to file your case by own your own you need to get permission from the court. and you need to follow the directions and maintenance of decorum of the court.

The court has the power under section 32 to allow anyone who isnt a registered advocate to appear in front of it. It is at the discretion of the court to allow you fight your case. One cannot demand this as a right, as it is not mandatory.

My father died intestate no will, his girlfriend filed probate but didnt notify me for 6 months . my father didnt have a wife and can prove it I filed an appearance with the court
