What to do my cheque bounced due to mismatch of signature

29-Jun-2023 (In Cheque Bounce Law)
Dear Sir/Madam. I Arup Sarkar issued a cheque to one of an agent of a DSA of a real estate company and told him not to deposit the cheque till my final confirmation ( as I have to go through with all the details of the property and waiting for the loan sanction and want to satisfy myself first) . But the executive deposited the cheque without my confirmation and the same was bounced due to signature mismatch. Now the executive threatening me that you will get legal notice for this and all and pressurised me to give the down payment of the flat . I AM GOING THROUGH A MENTAL PRESSURE NOW...PLEASE SUGGEST WHAT TO DO .

Does not panic as you have issues cheque with instruction "Not to deposit before you confirm the purchase of flat" and as I understand you did not wish to purchase the property from that real estate company. You can ask him to return the money if any taken for the said property. If they does not agree let them serve the notice. You can contact for reply of legal notice.

Just consult to a lawyer and file a case against him for cheat and forgery, before issued legal notice by him and and snd proper reply to him for your grievance and research on them. This is the only solution

Dont worry before he sends you the legal notice you send him the legal notice and mention therein , that I told the concerned authority to tell me before depositing the cheque so it the fault of the concerned authority not me.

Sir
Taking plea that you had given the cheque with an assurance that it had to be confirmed before clearing is normally not acceptable by court. Signature mismatch is seriously an offence of cheating and fraud.
