In how many days we may file case under section 138 and 420 after issue of Legal Notice.
In how many days Cheque bounce case is settled. what is the probability of punishment and double payment by court.

After giving notice you can file case within 45 days. Dear after the new amendment if opposite party want to fight the case than in that case magistrate will asked the accused person to give upto 20% cheque amount to complainant regarding that u have to move application. In this regard, i say that for intiating a complaint under Section 138 and 420 IPC, there is set time frame you have to follow, firstly, after the cheque bounce within 15 days you need to serve legal notice, after the receipt of such notice 15 days times period is given to him pay for the amount or reply and thereafter after the expiry of those 15 days, you get one month time to initiate complaint under Section 138 and 420. You have good chances to recover the amount as now a days in the initial period you are entitled for the compensation of 20 % olf the amount from the accused and getting double the amount of the cheque depends upon how you fight. Hi sir what is the Cheque amount and all what did he say what was the cheque amount and all what did he say. And all what did he say what did the person say andn all over again the chequ can be filed with months and fifteen days legal notice
Query perused. The complaint under section 138 can be filed within 30 days from the lapse of 15 days given in the notice. It depends. If the accused pleads guilty than in 6 months to 1 year.
