Subvention Scheme Security cheque bounce

My father had booked a flat in 2012 under subvention scheme home loan from DHFL. Builder did not construct the building and the liquidation matter is going on in court. Now DHFL has presented the security cheque and the cheque has bounced. I did not pay EMI because there was no construction. What relief do i have?

Cheque bounce litigation can only exist when the other side can show to the court that there was some liability against which the cheque has been presented, which in your case, the other side cannot. But my advice to you would be, to issue a proper reply to their legal notice, and contest the matter in the right spirit.

Dear Client,
Builder has failed as per commitment and terms and conditions, whereas , having seen all this issue they have got cheque bounced . Yes , if this is then intension is very clear. Now they may issue you a notice of cheque bounce.

sir, you are liable to pay EMI if there is a legal debt due on you. in your case, builder did not complete his part of the promise so you may not be legally liable to pay the whole amount due but it depends on the facts and circumstances of the case

you can file a case for recovery of money on the basis of cheque but that is also baared by law , just file a criminal complaint against them this is the only alternative or kindly consult to us. we will help you
