Q: Improper investigation by IO 498a
Fake 498a has been filed against me and family and also 354 against my 76-year-old father. during investigation I had handed some documents to the IO which he didn't add in the chargesheet and also denied getting anything, I don't have proof of handling the docs to him. I'm sure he was greased by wife side. FIR quashing might waste time and money, can I or father ask for reinvestigation of the matter and request a different IO this time? Any provision for this? Trial hasn't begun yet.

This will be punishable by law and the IO has to face action for wrong, faulty and incomplete investigation. There are provisions where you can seek interference of the court and direct investigation or atleast your documents to be included.

How can court issue a new date if Husband not reaches but wife already taken new date without proceeding. Will this be exparty it party doesnt appear

it will not be ex-parte just on 1 or 2 dates. neither did you appear nor did anyone appear on your behalf when the matter would've been called and the court would be pressed for time. that's why date was given without your presence.

Q: Cheque presented second on 92 upon the assurance of Accused
Cheque presented first time within 90 days upon assurance of Accused we presented cheque 92 days with memo insufficient funds came, now court says it is beyond 90 days, however 90 days limitation given by bank not 138, so what should we do? Cheque is of 2018 hardly chance to file recovery suit as my lawyer told. Please advise
