Cheque Bouncing Case Query on appeal against acquittal

Hello My father was accused in a cheque bouncing case which was registered in 2013. Finally after 8 years, he was acquitted by the district court in December 2021. Now today the complainant has sent us a copy of his appeal to high court against this acquittal vis his advocate. My question is what should we do now? Why he has sent this copy to us. How much time the high court takes to accept/reject his appeal, and approximately how much time we will be given to appear in court with our lawyer to produce our defense.

Hi. There is no specific time frame within which a case will be decided. It can be dismissed in the first date itself or it can go on for years.

You should hire an advocate. The court will issue notice to your father and ask him to appear on the specified date.

As the case will have to be defended in the High Court a copy was sent to you by the complaint as a advance service which is the requirement before filing such a matter before Court. kindly contact for further detailed discussion- the approximate timeline and legal strategy will have to be determined after looking at all the documents till date.

You should immediately engage a lawyer and get yourself represented in the High Court. The complainant in the cheque bounce case must have filed appeal against acquittal and it seems the High Court have issued notice to your father for appearance. You should appear through a counsel

You can share The summons served on you from the High Court the appeal is the right of the complainant as his complaint was dismissed and the accused was acquitted since he has filed the appeal you have a right to defend yourself you need to approach the court with your reasons of acquittal you should appear on the date the court has already fixed and also preferably filed your reply before the date so the court can decide it in a faster way

Every person aggrieved by any order or decision of any court has a right to appeal before a higher courts. Similarly this person also appears to have preferred an appeal against the acquittal order of the lower court. Nothing can be said about the time limit as this case might get rejected at the threshold also if the court finds it appropriate or it may take sometime as well. As far as appearance is concerned, you or your lawyer will have to appear on the next date of hearing.
