Builder Cancelled registration and gave cheques which bounced

I paid amount close to Rs 8.5Lacs to builder for flat booking in Noida in 2014. The builder was not keeping to his deadlines for construction or BBA. I asked for refund against cancellation. Builder gave cheques in Apr 17 with date of Jul 18. All cheques bounced. Filed a court case in Aug 17. The summon is not reaching them every time. Already 3 dates have been extended byTees Hazari Court. It says no addressee avlb at address. Court extending dates only. What to do?

Hi first of all do u have all the documents and all when was the cheque bounced and all which year was it what is the builder saying and all what is the correct address and all of the accused and all what is the court saying and all to u how many dates have been passed by and all u can go to the hc and all for the same or move a application and all

Hi,
You shall file a case of cheating against the builder and after getting your due money back you may withdraw the complaint. Further, you may ask for dasti service from court and can serve it to them yourself.

Now u can take legal action under RERA and other provisions available under law. Fix a meeting with documents so that I advise u accordingly . Don't delay otherwise time limitation barred and u cannot take any action against him . There is time limitation for filing case for cheque bouncing.

I have read your query as per which you have booked a flat in Noida in 2014.the builder did not Kelly his words and never kept his deadlines. but on your request he cancelled Ur booking of flat but he gave u post dated cheques of July 2018 but all got bounced but now you have filled cases in this Hazari court but you now not able to serve with the summons now you need an expert advocate to contest you matter
