Q: False marriage commitments or VOID marriage

Hi, I have married a person who does not want physical relationship or no kids of his own. Its an arranged marriage with proper saath feras according to HINDU customs. My inlaws do not communicate with me about grandchildren expectations nor they have kept any relation with me after marriage. I do not understand if someone does not have any future family planning then is this marriage valid? Under what ACT can i file for divorce after 5 yrs? We stay like brother and sister in the house.Its scam?

you can file divorce under sec 13(1)(ia) mental harassment of Hindu Marriage Act, stating that the inlaws and husband did not clarify anything about the kids prior to the marriage. also if you have had no physical relationship with your husband since the day you got married you can also file for divorce under hindu marriage act stating that marriage is null and void

Q: Court Marriage information to police

I have done court marriage from Bandra.Currently I am staying in my home.I would like to know when I will be leaving my home is it compulsory to go to the police station for informing them about the marriage? Can i send them intimation letter through post? I would like to know most of the couples who get marry in Mumbai are they required to go to the police station is it man? I don't want to face police and my family as the matter may become serious. Can I inform about the marriage through post?

it is not required and is also necessary to inform the police regarding the same. unless there is a suit pending in the court. if there is a domestic violence case or dowry case under criminal law. the Police is not concerned about your martial relationship



Q: Timeline for Remarriage post divorce

If i am married in India ( both partners are Indian citizen ), however, i get divorced in New Jersey ( US) , as I reside in the US. What is the time line that I need to wait to get remarried in India to an Indian partner . Considering the divorce as per New Jersey laws doesn’t have a clause for contested or uncontested. If one party gives summon for divorce there is no clause for objection & There is no mandatory waiting time .

first you will have to get a decree of divorce in a competent court in New Jersey. Then you'll have to file a Declaration suit for the same in India. And after that you can re marry. after filing the suit it takes around 6 to 7 months for the decree and then once you get the decree you can re marry immediately.
