Questions Answered by Advocate Shweta Joshi

Q: Court jurisdiction in divorce case.

Both the girl and boy are working at Mumbai since last 10 years and both are having Adhaar card with Mumbai address but girl has filed multiple cases against boy and his family at her parental place to harass them. Can we ask for shifting of atleast criminal cases to Mumbai. Kindly advise.

Advocate Shweta Joshi answered
you can apply for transfer of cases to the Supreme Court if states are different and can apply to the High Court if both places are in one state. Where is she working now? Usually convenience of female is seen to be upheld in such cases. if you want to transfer case you will have to show her current residence and job at Mumbai.

Q: how to transfer property from father to mother after death in india ?

Recently, my father passed away. How to transfer property from father to mother after death in Maharashtra? What is the process for it? How should we go about it?

Advocate Shweta Joshi answered
Hello! If the property is immovable property then you will have to obtain heirship certificate and if property is movable then succession certificate from court. then give noc of others and release rights of other heirs by executing release Deed

I have been paying child maintenance since 2008 from Rs.2500 onwards till Rs. 6000 per month. Daughter is now 25 years ,working and also teaches dance. Can I stop paying now.i am 56 years

Advocate Shweta Joshi answered
If your daughter is financially independent and earning enough to take care of herself, you can stop paying maintenance to her. Communicate fact with your daughter and check what her opinion is. legally you can stop paying it if she is able to maintain herself.

Q: Regarding POA Issue from US for Release Deed

Sir ,I have 3 Siblings one brother andtwo sisters , now One Sister staying in US , Family has decided to give the release deed of our Property to me , based on certain Amount , Now Sister who resides in US has to give a POA to my elder Sister who stays in Mumbai , She has Attested the Document with two witness signature with Indian Embassy in US , She has Signed on her side and By Mistake also has signed on Elder Sister , also she has not put her thumb/Signature impression near Photo

Advocate Shweta Joshi answered
Your younger sister cannot sign on behalf of your elder sister. Further, POA must be in the appropriate format. There should be a signature of a person giving authority or power. his or her photograph is required. otherwise it would not be admissible at the registration office. It needs to be executed by the Notary Public in India before filing it anywhere.
