Q: Annulment vs divorce which will be good for me i dont want a divorcee

Team i got married on 17th march 2020 pune court marraige , it was a love marriage. as marriage happened my wife went to her hometown as lockdown was gng to start till now she is in her hometown. after marriage we have never stated together as it was court marriage ,her parents said in nov once Hindu marriage happens then you stay. so no physical contact after court marriage now we were in relation for 5 months before we got married. reason i did court marriage so early i am about to o to europe so i wanted to take her with me now as sson as she got home our small fights beacem big recently she told everything at her home pl note here we had verbal spats on trust issues as she had cheated me before marriage but i forgive her and married her now she has blocked me n family from everywhere her dad calls my home says akshay ka gussa hai and all i have not said about her anything bad at my home she has spitted venom against me in her family i was not aware about all this before i married

No annulment or divorce can be filed unless one year is elapsed from the date of marriage .If u wish to then we have to seek special permission for filing from the court . annulment has certain grounds which cannot be applied in your case so it is better for a mutual divorce.

Q: Rights of daughter of divorced women

If divorced is done by mutual concent using only 13b in that if it is that father is liable to pay some amount to daughter till daughters age 18. in such cases if during this period if father refuses to give the said monthly money to daughter Then can we file any legal complaint against the father.

daughter can seek the remedy as per sec. 125 of crpc for maintenance if the mother is unable to maintain her being a minor. plus the mother too can seek maintenance if unable to maintain herself even after the divorce.

Q: Wife Threatning to file false 498a on me and family.

Hi Advocate, My wife is picking fights on every next day with me or my family without any reason. As she is 3 months pregnant we are trying to let it go and trying to behave well with her. She abuses me and family and threaten us of filing false cases against us. We haven't taken any dowry during marriage and also we have done 90% of marriage expense as they were not well to do and as this was second marriage for her(she had one failed marriage earlier). Pleae help us out as we are in deep trouble. Thank you.

Q: What to do if a boy is continuously calling and texting me ?

A person name is troubling me by giving multiple of messages and calls. I had even warned him and not to call and give messeges. But still he calls me and texts I love you etc. It is almost 4 months now. I even scolded him and said not to give any messeges else I will report him to cyber crime. But he says "I'm not doing anything wrong. I m just texting I love you. And I want to marry you. But you are doing wrong. You are scolding me. And I can also report you as you are scolding. But I will not bcoz I love you". Always he texts I love you. Whenever I warns him he says please dont decline and please dont avoid me, I love you.Sometimes he send messeges at even in mid night 4am. Sometimes he calls at 5am and disturbs me. Always I see he writes I love you, good morning etc. My mother and my cousin also warned him not to text anything. But still he text me. I am irritated. He is from puri orissa. Sir/ mam plz suggest me what should I do ?

kindly prepare a complaint application and file it before the police station of your jurisdiction they will initiate action against the culprit . Other option in case the local police station is not taking any action get in touch of a lawyer to guide u accordingly.

Hi, The case is in Final Arguements stage I now traced out a vital evidence which I did not submit at Affidavit of Evidence stage or additional Evidence stage If I submit now in arguements stage will the Judge in District consumer Forum accept it ??

try and convince the judge and file the application for additional evidence as the cases are tried summarily in the Consumer forum they might entertain your application if u have a valuable evidence to prove.
