Can a person transfer the entire property in the name of third person

What should i do if my father make a register will that in his property his not belong to his only son and all property will be of 3rd person? Should i claim on that property?

Hi,

The case depend upon the question whether it is self acquired or ancestral property..? If self acquired your father can transfer it to any third person, he can dispose it vide will in favour of any other person.

Wise saying "Serve your parents". You should first of all try yourself. If not successful, then try it through close relatives and friends of your father to not to will the property to third person. Secondly, you can compel your father not to do it, only if the property is ancestral. You can apply for partition of the property and thereafter you will be able to make use of at least your share.

If the property is your father self acquired property i.e. from his own income than in that case he can give the same to a third person however if the property is incestral then he can give only his share to third person and you can claim your share out of that property

If your father is hindu and the property is his self acquired property, then he has all rights to dispose of his properties by way of will in favour of any person including the non-blood relative. But if the property is not self acquired and the same is ancestral one, your father cannot transfer the said property in favour of third person.
If your father is Muslim, then he can transfer only 1/3 property in favour of third person, whether self acquired or inherited.
