Remove the person from property since he is not the owner

I want to know if I am the owner of the property, how can I proceed legally to remove my son from this property. He is not ready to leave the property saying that he won’t leave. But he is attempting domestic violence of me and I’m not willing to keep him here in the same house. Please advice.

Dear sir,

You have two options through which you can evict your son out of the property.

1. You can file a suit seeking eviction of your son from the property.

2. You can file a petition before the maintenance tribunal governed by ADM.

This also include the monitoring by the sdm court as to no domestic violence should happen at the moment.

In these circumstances if you are the absolute owner of the property then it makes the said property self acquired in nature.
Therefore you have the right to make a will in regard to your property stating that you wish to disown your son entirely or partially.

Thereafter you can evict him by virtue of filing a suit against him.

The only option available to you is to file for possession after issuing notice to the person who is in alleged illegal possession of the property. The court has to be brought in between as no one can forcibly dispossess anyone even if he is illegally occupying the property.
