Builder made false promises as to the allotment of the parking slot

I have booked a flat in G+12 tower which has ground plus podium parking. In registered document builder has mentioned a clause that parking will be given by way of lottery allotment at the time of OC or possession and same was told to me for parking. Now OC is received and soon will be possession. Now the builder is asking 3 lakh cash for one stilt parking. There is no lottery system allotment. I also learnt he has sold parking to other customers after me and has also mentioned parking number in their registered documents, but to me he lied. He has even sold two parkings to other purchasers. What I can do now.

From your explanation it is prudent that the facts have been misrepresented and you have been cheated. You can file criminal case against builder for breach of trust and cheating. You can also file a consumer case for deficiency in services. If the purchase falls under the purview of RERA then you can Lodge a complaint with regulatory authorities. Please do collect all proofs before hand and similar instances with other parties to make your case strongly presentable.

please send legal notice to the builder for the false statements and promises and cheating as well as immediate allotment of the parking space to you.

if the builder does not replies in writing to you then you will have to file court case in Civil Court as well as separate complaint in consumer court.

You need to send legal notice to builder seeking clarification and approach the Consumer Forum asking for parking space as agreed and inform the Forum about such illegal sale of Parking space, you can also file cheating case against the builder in police station or private complaint to the Magistrate Court.
