How to initiate divorce and gain maintenance

My sister and her husband bought a property together.My sister is first applicant and hence she is in the government job she got loan on join account on the basis that her husband Will pay the EMI. now he stop paying EMI and the relationship between them is not ok. What should we do?

Your sister get loan and she have to pay the EMI what her husband do os he in govt job or something else.How many kids they have.For divoe
Divorce shebhabe to file divorce application before family court for maintainence it depends.

Well your question is in two part first part is that your brother in law cannot be forced to pay emi for a property taken in name of your sister. Yes she is entitled for maintenance in case she is unable to maintain her to a standard of her husband

Your sister can initiate a divorce proceeding. The divorce peoxeeding can be either mutually or contested. She can file a divorce petition u/s 13 Hindu Marriage Act. So far as maintainance is concerned, she can file maintaince petition at any time during the divorce proceeding.

A divorce proceeding would be initiated after a petition for divorce is filed by either of the party in the lower court. As far as the EMI is concerned it can be claimed by your sister in her maintenance.

As per law u could file pettion in family court for maintaince .As per ur case u can claim divorce on being seperated for 6 Month.u have right claim maintaince for ur livelihood .U are not treated well by ur husband .

She is filled maintenance case in family court that's your jurisdiction family court against husband cr.p.c act 125 than court order to provide maintenance allowance to pay the husband capacity amounts
