Can woman live in matrimonial home under DV act

14-Sep-2023 (In Family Law)
As part of DOmestic Violence act, is there provision for a woman pushed out of her marital home to ask for her to gain entry again into the shared house hold after evicting the inlaws who were harassing her? The shared household she was part of has already been disposed off by her inlaws and hubby as it was a rented house. But can she now ask for entry into the new home where her husband stays?

Yes. Under section 19 of DV act the court can direct the husband to secure same level of alternate accommodation for the aggrieved person as enjoyed by her in the shared household or to pay rent for the same, if the circumstances so require. In your case since the shared household was disposed off she could ask for alternative accommodation.
