Wife never allowed me to have physical relation what to do

I got married on 31.01.2016.. n she leaves my house on 11.09.2016 . * there was no physical relation between us, she never allows me . *she doesnt do any responsiblities as a wife or as a DIL * she sometimes behave like she has some mental issue. * i approach to delhi goverment mediation centre .. and they send them notice for hearing twice , but wife and her family resist to receive that notice .. (she didnt file any case till now) What should i do now? What case should i file ? ( what are the pors and cors of that case as husband to me) Indeed of your help ..in a unbearable mental pressure ..
You should file for restitution of conjugal rights under Section 9 of the Hindu Marriage Act in case you wish to have her back, otherwise if you are seeking divorce, you should file a petition for divorce on the grounds of cruelty. Denying intercourse and refusing to fulfill the duties as a wife come under mental and physical cruelty on which grounds you can seek divorce. The downside of filing such a petition are none but only that you will have to pay maintenance to her if she asks for it. Best case forward is to request them to file a mutual consent divorce.

Hello there, after going through your query, in my opinion you should first think about whether you really want to live with your wife , and you would have to make your mind accordingly. If you want her to get to you , thus as per Law you can file a petition for Restitution of Conjugal Rights , where through Court you will ask her to live with you. Dear, as per your query,primarily if the marriage is not consummated or conjugal relationship has not been established between both of you, thus its null n void. 3.(she didnt file any case till now) What should i do now? ____For this you have to decide what you want either you want to continue your marriage or not.
4. What case should i file ? _____For this After deciding third point , you can go for divorce case.
