If both husband and wife are agreeable on terms and conditions such as alimony, maintenance, child custody, guardianship, child support, Stridhan (if all these are applicable to your case), then mutual consent divorce can be filed which will take not beyond 6 months. If there is dispute qua limony, maintenance, child custody, guardianship, child support, Stridhan etc. then there is no time limit as trials would have to proceed for adjudication.

Dear Ma'am,

You may not be able to file a petition for divorce on the grounds of mutual consent before one year of marriage. Under exceptional circumstances, you may file a petition along with section 14 of HMA Application for waiver of one year waiting period.

You can file divorce case only after one year of marriage. But in the mean time you can file other cases like crl case u/s 498 a,406 ipc. Cases to take maintenence from your husband. Etc get prepare divorce case. It is not clear whether your husband is also ready to take divorce or not.

Divorse can be taken by various methods. They all take different criteria and procedure. Who wants to apply the divorce, is it from the side of wife or husband. So time is taken to obtain the divorce also varies. It cannot be said that divorce will take this much time.

The time to obtain a divorce depends on various factors. I.e. Facts & issue involve in the case, nature of the presiding officer, conduct of your counsel and opposite in counsel in the proceeding, No. Of witnesses to be examined and lastely possibility of settlement etc. so it not possible for any advocate to give certainity regarding any exact time. Then again if you win if opposite party challanges the dercee & order of family court etc. Minimum time if there is posibility of settlement it may take 6-7 months for both months.
