Facing mental and verbal abuse can sister ask half share of husband

Sister has been married for almost 10 years. Husband is a drunkard and beats a lot. There is no kid.If sister wanted divorce, we wanted to know what our rights are? Can she ask half share in husbands assets.

Yes if she want divorce so he can ask half share as maintainence ,this will be one time settlement of maintainence for your sister.so your sister can file divorce suit ,if she wants to stay in that house so she can stay this house.

You can file a divorce suit in the court as the grounds for divorce are valid, in case your sister's husband is a regular drinker and is causing physical cruelty to your sister. You can also file a complaint under the domestic violence Act. Your sister does have a right to claim maintenance/permanent alimony.

Your sister can get divorce on this ground alone. She can file case under Indian penal code and also another complaint under the protection of women from domestic violence act against all the person responsible for cruelty.

Sir, your sister can file a case of maintenance under section 125 CR.P. C. As far as share in the property is concerned, she can demand permanent alimony. But when she would be getting money from husband, same time she can claim shared household under Domestic Violence Act. And she shall h a very right to live in the husband's house and use joint things.
