Can I file an RTI to municipality for tax criteria

Sir/Mam, myself reside in a municipal area. Our municipality has imposed a certain amount of house tax. Can I ask for the basis of taxation as well as criteria for imposing the said amount from the municipality under RTI?

Ofcourse. Knowing on what basis and / or on what grounds, such calculations has been made, is your right. You need to send a notice. If it does not work then a write before the Hon'ble High Court, challenging the same, and if really no supporting calculations is being provided to you then payment of such fees will be stayed immediately. If you have a good case, such assessment can be quashed and order for fresh assessment can be done. But for being so sure and deciding further course of action I have to peruse the documents. Definitely. you have right to file RTI and ask for the basis structure of house tax. And as per the said criteria if you see that, the Municipal authority claim more than the Tax fixed in the said chart, then you submit a petition before the concern authority for re-calculate your house tax and re-issue the notice.

You can always file an RTI application in the prescribed format. This is not an exempted for which the Municipal Authority can refuse to answer you. They should give up reply within the period of 1 month as prescribed in Law.
