Brother not willing to get property partition done, how to execute?

We are 2 sons, Iam younger one, Iam single not married, My brother was married, we have 20 acrs agriculture land, Now me and my parents want to take ancistral part of my land, my parents are ready to give. But my brother not ready to give. He making alienation. And he looks to take and use all praperty to agriculture cultivation. Now I want stop him, can I get the court stay up to partition as by my father.

Hi, you can directly file a suit for partition, meanwhile u can get injunction against your brother n his men not to interfere into d property until partition was made, you can file a suit, wher S d people located

Dear Sir,

File a partition suit in the concerned civil court and an application for ad-interim injunction (STAY) along with the suit to restrain your brother from alienating,selling,transferring,exchanging or leasing the property to third persons. The court will first dispose off your ad-interim injunction application and then proceed with the partition suit. Engage a civil court lawyer and proceed.

yes. you can file a suit for partition and claim your share of property in the agricultural land.
Also you need to ask for mesne profits if your brother is already cultivating the land and enjoying the proceeds alone.
